Abstract

Comments on the Court of Appeal decision in Palmer v Cornwall CC on whether a council was liable in negligence for an injury sustained by a secondary school pupil who was hit in the eye by a stone during a lunch break on the ground that the provision of two "dinner ladies" to oversee approximately 400 children constituted inadequate supervision. Details the implications of the ruling for local authorities, its impact on existing case law, the different standards of care expected of adults and children, and the factors determining "adequate supervision", including the age of the children concerned.
