Abstract

Examines the House of Lords rulings in Reynolds v Times Newspapers Ltd and Jameel v Wall Street Journal Europe SPRL (No.3) on whether the qualified privilege defence to libel applied to the publication by newspapers of information on matters of public concern. Considers the impact of the Reynolds ruling, arguing that the tests for the defence of qualified privilege developed in the case have led to uncertainties on key questions. Discusses the response of the House of Lords in the Jameel case to criticisms of the operation of the Reynolds defence.
