Abstract
Considers whether employment contracts are relational contracts, and the implications of such a classification. Reviews the emerging concept of relational contracts since Johnson v Unisys Ltd (HL), the legal rules governing their operation, their contextual application, and how parties have varied or adjusted them. Discusses their use in long-term business relationships involving intermittent transactions, and the position regarding good faith.
