Comments on the Court of Appeal decision in Selwood v Durham CC on whether it was fair, just and reasonable to impose a duty of care on NHS trusts with whom a local authority social worker collaborated in the course of her work to warn her of threats made against her by a voluntary mental patient, and whether there had arguably been a breach of her rights under the European Convention on Human Rights 1950 art.2. Considers the difficulty of judging how seriously threats should be taken and the persons to whom a public service may owe a duty to protect, noting the role of public policy factors.
