Abstract

Comments on the Court of Appeal decision in Chandler v Cape Plc on whether a parent company could be fixed with responsibility for the health and safety of a subsidiary's employees on the basis of a direct duty of care, particularly in a case of asbestosis arising from exposure at a time when the parent company employed specialist medical and other staff who oversaw health and safety issues arising at the subsidiary and could be taken to have superior knowledge of the risks. Considers the extent to which the case reflects typical features of asbestosis litigation and its potential impact.
