Evidence of a defendant's propensity to commit offences is admissible under the bad character provisions of the Criminal Justice Act 2003. This article explores how propensity is understood under the Act, and in particular examines the distinction that is drawn between propensity and "coincidence& quot; cases. It highlights a number of misunderstandings, including some which, if acted on, may render convictions unsafe.
