Abstract
This chapter explains and criticises the decision of the Supreme Court in Guest v Guest [2022] UKSC 27. That case considered the question of what remedy should follow a successful claim in proprietary estoppel. The chapter considers three criticisms that can be made of the decision in Guest and argues that the Court's reasoning either fails to engage with or to overcome each of those criticisms. It does so with reference to recent judicial decisions that have attempted to apply Guest.
