Abstract

Explores the criminal liability imposed on companies for causing pollution, set out in Environment Agency (Formerly National Rivers Authority) v Empress Car Co (Abertillery) Ltd (HL), arguing that viewing the pollution event from a control principle perspective provides a better way of analysing criminal responsibility in such circumstances.
