Abstract
This article illustrates how creative destruction in the ICT industry has created a demand for innovations in institutions and business models in a changing environment of intellectual property protection. We argue that changes in institutions of intellectual property are unlikely to be ‘co-evolutionary’ in the sense of being aligned with changes in technologies. The effect of a ‘mis-aligned’ intellectual property system constitutes a social welfare loss against which the benefits and costs of particular intellectual property systems must be assessed.
